You are on a Work Visa in the UAE. However, you need to travel out of the country due to an emergency. What happens to your Work Visa?

Well, your employer may cancel your Work Visa is you stay out of the UAE for more than 6 months.

For those, who have resigned and served their notice period, your employer can cancel your Work Visa without you travelling back to the UAE. However, you should have signed the Work Permit cancellation document before you moved out of the UAE.

An employer needs to approach the Ministry of Human Resources and Emiratisation to cancel your Work Visa. They then need to get in touch with the General Directorate of Residency and Foreign Affairs to get your Residence Permit revoked.

An employer needs to have a signed Work Permit cancellation document from the employee before he can apply to get the Work Visa cancelled at MOHRE. The document should also state that the employee has received his due remuneration and also the benefits at the end-of-service.

However, if an employee has been absent from the UAE for more than 6 months, then the employer may cancel the Work Visa of the employee. The employer would need to get a report from the GDRFA that the employee has been out of the UAE for more than 6 months. With that, he can then submit a Work Permit cancellation application, as per The Khaleej Times.

If, however, the employee has not been out of the UAE for 6 months, he can travel back to the UAE with his current residence visa. He can then submit his original passport to the employer to cancel his Residency Visa.
