IRCC Expands Open Work Permit Eligibility for Spouses and Children from 30th Jan, 2023

Highlights: Extension of Eligibility for Open Work Permit by IRCC

  • Dependent children and spouses can now stand a chance to qualify for work in Canada from 30th Jan 2023
  • IRCC announces a revised eligibility criterion for the open work permit.

Spousal Open work permit (SOWP)

SOWP refers to a Spousal open work permit that lets candidates be employed by any Canadian employer. It is precisely for spouses of candidates with a work permit or a study permit. It also includes individuals sponsored under the Spousal Sponsorship Class in Canada.

Revised eligibility for SOWP: 2023-2025

You become eligible for the SOWP for 2023-25 starting from 30th January 2023 if –

  • You are a spouse, common-law partner, or dependent child of a work permit holder who works in Canada.
  • Is employed under the NOC TEER
  • Is an applicant with an open work permit
  • With a spouse or dependent of an economic class PR with a work permit.

 Eligibility criteria for SOWP

The eligibility usually depends on your relationship, whether you are applying as a partner, student, etc., under the Canada spousal sponsorship class. Given below is a list of criteria that one must comply to –

  • A law partner of a work permit holder employed in the NOC TEER of any position.
  • Have a sponsorship under the Spousal Sponsorship Class in Canada.
  • If you happen to be a spouse of a qualified foreign national with proof of relationship.
  • It would be best if you were not forbidden in any way by the Canadian country.
  • If you are related to a work permit holder eligible for the Global Skills Strategy.
